  • Health and Personal Information provided via our counselling referral form (e.g. your name, contact details, health and mental health information).

  • Technical Information (IP address, browser type, device data) through cookies and analytics tools.

  • Communication Data (e.g. emails or messages you send to us).

 

4. Legal Basis for Processing

We process personal data where we have a valid lawful basis under GDPR, including:

  • Your explicit consent for health data (Article 9(2)(a) GDPR).

  • Compliance with legal obligations under Irish law, including the Children First Act 2015.

  • Our legitimate interests to maintain our services, improve our website, and safeguard visitors.

 

5. Confidentiality and Limits

Your confidentiality is extremely important. However, confidentiality may be limited if:

  • You present a serious risk of harm to yourself or others.

  • Child protection concerns arise under the Children First Act 2015.

  • A legal duty requires us to share information with the appropriate authorities.

We use trusted third parties to help run our services, including:

  • Wix.com Ltd. — hosts our website and online forms.

  • Google Ireland Ltd. — provides email communications and Google Analytics.

Both act as data processors under GDPR. Personal data is transferred securely using encryption (SSL/TLS), and we have data processing agreements with these companies.

 

7. Website Analytics and Cookies

We use cookies and analytics tools to understand how people use our website so we can improve our services:

  • Wix Analytics — Wix places cookies that help us monitor basic visitor activity on our website.

  • Google Analytics — places cookies to analyse trends and measure website performance.

  • These tools only process pseudonymised data like browser type, approximate location (e.g. city), page views, and session length. They do not directly identify you.

8. Role of Counsellors

Futures In Mind CLG is a facilitator of funded counselling sessions. Our counsellors are independent practitioners who must meet specified qualification and registration criteria before joining our panel.

When you are referred:

  • You enter into a private client–counsellor relationship with your assigned independent practitioner.

  • Futures In Mind CLG does not hold your counselling notes or clinical data — those are held solely by your assigned counsellor.

  • Futures In Mind CLG arranges funding and venues, but all clinical decisions and records remain the responsibility of your independent counsellor.

 

9. Data Retention

We will retain your personal data only as long as necessary to provide our services, comply with legal obligations, or resolve disputes — typically up to 7 years, after which data is securely deleted or anonymised.

10. Data Security

We use appropriate technical and organisational measures to protect personal data. However, please note that no data transmission over the internet can be guaranteed to be 100% secure.

 

11. Your Data Protection Rights

You have rights under GDPR, including the right to:

  • Access a copy of your personal data.

  • Rectify inaccurate or incomplete data.

  • Erase your data (subject to legal obligations).

  • Restrict processing of your data.

  • Data portability — receive your data in a structured, commonly used format.

  • Withdraw consent at any time.

  • Lodge a complaint with the Data Protection Commission at www.dataprotection.ie.
